Is Credit Repair Legal?

By law, your credit report MUST contain accurate and complete information. It wouldn’t be fair to pay higher interest rates because inaccurate / incomplete information is lowering your credit scores.

Do I need an Attorney?

Your Attorney can help you enforce your Divorce Decree by going back to the courts to get your ex to pay the bills they are obligated to pay in the Divorce Decree. We will address the problems on your Credit Report by dealing directly with the Creditors and the 3 major Credit Bureaus.

Can Creditors come after me if my ex doesn’t pay the bills he is responsible for as clearly stated in our Divorce Decree?

Yes they can. Even if your Divorce Decree says that your ex is responsible for paying certain bills, if the account is a joint account, you are responsible for the debt. This is because the Creditors were not parties to the divorce. A court cannot overturn the legal agreement unless they are considered fraudulent or not lawful. We have successfully worked with Creditors in separating joint accounts.

Should I continue to pay bills that are joint accounts?

Yes, until the account has been successfully transferred to your ex or an agreement has been reached with each Creditor. If you do not pay the bills and your ex doesn’t pay them either, it will show up on both of your credit reports as a negative lateness. The Creditor may require you re-apply individually and take responsibility for half the remaining balance owed.

What can I do to protect myself if we have a joint mortgage?

The first thing you can do is sell the home. If selling the home is not something you would like to do, you can refinance the home into your own name. You can refinance the home in your ex’s name but you will be at the mercy of your ex because if they do not pay the mortgage the bank may foreclose on the property.

Can I do this myself?

Yes you can. The question is, which way will you be more successful? You can review your credit report, find inaccuracies and/or incomplete information and dispute it on your own. It is very important that you understand your rights before attempting to repair your own credit. Do you have the knowledge and the time to get the results you are looking for? Your credit is vital to your financial future.
